1. Introduction & Acceptance

Welcome to the Kenya Tchoukball Federation ("KTF") website. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Kenya Tchoukball Federation ("KTF," "we," "us," or "our") governing your access to and use of our website located at tchoukball.ke and all associated services.

Members must respect other members, officials, and participants

6.2 Membership Benefits

Membership benefits are personal and non-transferable
Benefits may vary based on membership tier
KTF reserves the right to modify benefits with reasonable notice

6.3 Membership Renewal & Expiration

Membership is valid for the period specified at registration
Renewal is required to maintain active membership status
We will send renewal reminders before expiration
Lapsed memberships may require re-registration

7. Purchases & Payments

7.1 Pricing

All prices are displayed in Kenyan Shillings (KES) unless otherwise stated
Prices are subject to change without prior notice
We reserve the right to correct pricing errors
Promotional offers are subject to specific terms and availability

7.2 Payment Methods

M-Pesa: Primary payment method via Safaricom M-Pesa
Other payment methods may be available as indicated at checkout
Payment is processed securely through authorized payment processors

7.3 Order Confirmation

8. Refund & Cancellation Policy

8.1 Event Registrations

7+ days before event: Full refund (minus processing fees)
3-7 days before event: 50% refund
Less than 3 days: No refund
Event cancellation by KTF: Full refund or credit for future events

8.2 Merchandise

Returns accepted within 14 days of delivery
Items must be unused, unworn, and in original packaging
Custom or personalized items are non-refundable
Shipping costs for returns are the customer's responsibility unless item is defective

8.3 Memberships & Subscriptions

Membership fees are generally non-refundable after activation
Pro-rata refunds may be considered for exceptional circumstances
Contact us within 14 days if you wish to cancel a new membership

8.4 Donations

Donations are generally non-refundable. Contact us for exceptional circumstances.

9. Intellectual Property

All content on this Website, including but not limited to text, graphics, logos, images, videos, software, and the overall design and compilation, is the property of KTF or its content suppliers and is protected by Kenyan and international copyright, trademark, and other intellectual property laws.

The KTF name, logo, and branding are trademarks of Kenya Tchoukball Federation

KTF's total liability for any claims shall not exceed the amount you paid to us in the 12 months preceding the claim

These limitations apply regardless of the legal theory (contract, tort, or otherwise) and even if we have been advised of the possibility of such damages.

18.1 Termination by You

19. Dispute Resolution

19.1 Informal Resolution

Before initiating formal dispute resolution, you agree to contact us first at [email protected] to attempt to resolve the dispute informally. We will work in good faith to resolve any issues within 30 days.

19.2 Mediation

If informal resolution is unsuccessful, the parties agree to attempt mediation before the Nairobi Centre for International Arbitration (NCIA) or another mutually agreed mediator. Each party shall bear its own costs, with mediation fees shared equally.

19.3 Arbitration

If mediation is unsuccessful, disputes shall be resolved through binding arbitration administered by the NCIA in Nairobi, Kenya, under its Arbitration Rules. The arbitration shall be conducted in English. The arbitrator's decision shall be final and binding.

19.4 Exceptions

Either party may seek injunctive relief in court to protect intellectual property rights or prevent irreparable harm.

20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.

For matters not subject to arbitration, the courts of Kenya shall have exclusive jurisdiction. You consent to the personal jurisdiction of the courts in Nairobi, Kenya.

21. Force Majeure

KTF shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to:

Natural disasters, epidemics, or pandemics
War, terrorism, civil unrest, or government actions
Power outages, internet failures, or telecommunications disruptions
Strikes, labor disputes, or supply chain disruptions
Any other event beyond our reasonable control

22. General Provisions

22.1 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and KTF regarding the use of the Website and supersede all prior agreements and understandings.

22.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

22.3 Waiver

KTF reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on the Website unless otherwise stated.
